This website is operated by The Coral Pro. Throughout the site the terms "we" "us" and "our" refer to The Coral Pro. By visiting our site and purchasing something from us you engage in our service and agree to be bound by the following terms and conditions including those additional terms conditions and policies referenced herein. These Terms of Service apply to all users of the site including browsers customers and visitors.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement then you may not access the website or use any services.

SECTION 1 — ONLINE STORE TERMS

By agreeing to these Terms of Service you confirm that you are at least 18 years of age. You may not use our products for any illegal or unauthorized purpose. You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your services.

SECTION 2 — GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content may be transferred unencrypted and involve transmissions over various networks. You agree not to reproduce duplicate copy sell resell or exploit any portion of the service without express written permission from us.

SECTION 3 — PRODUCTS AND PRICING

All products are subject to availability. We reserve the right to discontinue any product at any time. Prices for our products are subject to change without notice. We reserve the right to refuse or cancel any order placed for a product listed at an incorrect price.

Live Coral Disclaimer: All live coral is a perishable living animal. Colors patterns and sizes may vary slightly from photos shown due to the natural variation of live coral and differences in aquarium lighting. Representative photos are used for cut to order listings and show the mother colony your frag will be cut from. WYSIWYG listings show the exact piece you will receive. We make every effort to display our corals as accurately as possible however we cannot guarantee that your device screen accurately reflects the true color of our coral.

SECTION 4 — ACCURACY OF INFORMATION

We are not responsible if information made available on this site is not accurate complete or current. The material on this site is provided for general information only and should not be relied upon as the sole basis for making decisions. Any reliance on the material on this site is at your own risk.

SECTION 5 — MODIFICATIONS TO THE SERVICE

We reserve the right at any time to modify or discontinue the service or any part of it without notice. We shall not be liable to you or any third party for any modification suspension or discontinuance of the service.

SECTION 6 — BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may in our sole discretion limit or cancel quantities purchased per person per household or per order. In the event that we make a change to or cancel an order we will attempt to notify you by contacting the email address provided at the time the order was made.

You agree to provide current complete and accurate purchase and account information for all purchases made on our site. You agree to promptly update your account and other information including your email address so that we can complete your transactions and contact you as needed.

SECTION 7 — PAYMENT

We accept all major credit cards debit cards Apple Pay and Google Pay through our secure payment processor Shopify Payments. All transactions are encrypted and secure. We do not store your credit card information. Payment is due in full at the time of purchase. We do not offer payment plans or layaway on live coral.

SECTION 8 — SHIPPING AND DELIVERY

All live coral ships via FedEx or UPS Overnight only. We ship Monday through Wednesday only. Please refer to our full Shipping Policy for complete details on shipping procedures weather holds and delivery requirements.

The Coral Pro is not responsible for delays caused by the shipping carrier weather natural disasters or any other circumstances beyond our control. In the event of a carrier delay we will work with you on a case by case basis.

Risk of loss and title for all items purchased from The Coral Pro pass to you upon delivery of the items to the carrier. Once a package is in the carriers possession The Coral Pro is not responsible for loss damage or delay caused by the carrier.

SECTION 9 — RETURNS AND REFUNDS

All sales of live coral are final. We do not accept returns on live animals under any circumstances. The only exception is coral that arrives dead on arrival which is covered under our Arrive Alive Guarantee. Please refer to our full Arrive Alive Guarantee policy for details.

Refunds are not issued for coral that arrives stressed but alive coral that dies after arrival due to tank conditions or improper acclimation or for any reason not covered by our Arrive Alive Guarantee. Shipping costs are non-refundable under all circumstances.

SECTION 10 — ARRIVE ALIVE GUARANTEE

Our Arrive Alive Guarantee covers coral that is confirmed dead on arrival. Photo proof must be submitted within 2 hours of the carriers delivery scan. Please refer to our full Arrive Alive Guarantee policy for complete terms and conditions. The Arrive Alive Guarantee is void if any of the conditions outlined in that policy are not met.

SECTION 11 — PROHIBITED USES

In addition to other prohibitions set forth in these Terms of Service you are prohibited from using the site or its content to violate any applicable local state national or international law or regulation transmit any unsolicited or unauthorized advertising or promotional material impersonate or attempt to impersonate The Coral Pro any employee another user or any other person engage in any conduct that restricts or inhibits anyones use or enjoyment of the website use the site in any manner that could disable overburden damage or impair the site use any robot spider or other automatic device to access the site for any purpose or introduce any viruses malware or other harmful material.

SECTION 12 — DISCLAIMER OF WARRANTIES

We do not guarantee warrant or represent that your use of our service will be uninterrupted timely secure or error free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. The service and all products and services delivered to you through the service are provided as is and as available for your use without any representation warranties or conditions of any kind either express or implied.

SECTION 13 — LIMITATION OF LIABILITY

In no case shall The Coral Pro its directors officers employees affiliates agents contractors interns suppliers service providers or licensors be liable for any injury loss claim or any direct indirect incidental punitive special or consequential damages of any kind including without limitation lost profits lost revenue lost savings loss of data replacement costs or any similar damages whether based in contract tort strict liability or otherwise arising from your use of any of the service or any products procured using the service. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.

SECTION 14 — INDEMNIFICATION

You agree to indemnify defend and hold harmless The Coral Pro and its affiliates and their respective officers directors employees and agents from and against any and all claims liabilities damages losses costs expenses or fees including reasonable attorneys fees arising from your use of our website or services or your violation of these Terms of Service.

These Terms of Service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Texas.
